Surrogate Decision making and Informed Consent.  RCW 7.70.065  This is the statute that sets out who may act as surrogate decision maker for people who are incapable of speaking for them selves. Under Washington law next of kin, guardians and people appointed under durable powers of attorney for health care are legally able to give consent as surrogates
